Can you imagine arriving to work one day, sipping your morning coffee, checking your email, prepping for a 10 o'clock - you know, business as usual - only to hear a helicopter circling overhead followed by the footsteps of armed men who don't just want to talk to you, but demand the keys to your loaner BMW 325?
It would be alarming to say the least - especially if you weren't involved with any illicit activities. I mean we're talking guns, lots of them, and a freaking helicopter. We imagine the thought process would be something like this: Hmmm, that helicopter sounds rather close > Is it getting closer? > I wonder what's happening .> Oh my god. > What are these armed men doing here? > What's happening > [Expletive], they're here for me…for my BMW loaner? > I'm alive.> I'm alive. > That was really messed up.> I mean really [expletive] unacceptable. > I need to call my lawyer. > They won't get away with this.
Unfortunately, one South African man, by the name of Ravindra Jainarian, doesn't have to imagine this scenario. He lived it.
That's right; giving a whole new meaning to extreme repossession, the dealership from which he bought his new BMW 320d and to whom it took it to, to get the AC repaired hired all of the right people and equipment to create the scene outlined above.
Dissatisfied with the original fix, Javarian was using the loaner car until they repaired the AC unit to his expectations or otherwise gave him a new BMW with working AC. Thinking this was unacceptable and not compliant with the terms agreed upon, the dealership took what can only be described as extreme measures. Though somehow that still seems like an understatement.
We're happy to say that at this time, the loaner vehicle keys are back in the hands of Javarian, who called his lawyer immediately following the repo/invasion. Bavarian automaker, BMW has also gotten involved, giving Javarian license to use the BMW 325 throughout the course of the trial. The dealer does not agree with this, arguing such a dispute can last years. Luckily, for Javarian, they don't have the final say.
How will all of this turn out?
BMW of Silver Spring conveniently located at 3211 Automobile Blvd Silver Spring, MD 20904 is confident the High Court will side with Javarian, too. However, you never know what twists and turns might happen along the way. So, be sure to stay tuned as we bring late-breaking updates.
